Separation advise

Hi , my wife and I are separating and she wants me to move out the family house due to me cheating, the house is in my name only , do I have to move out as if I do she is entitled to various benifts from me and maintenance. She has also cheated on me as she is seeing another guy 3 months into our separation. Even though I own the house outright we have mutually agreed that when we do sell we will go 50/50 but I need some kind of protection knowing there is a 3rd party involved. Any advise will be appreciated.
Thanks

Re: Separation advise

I would have thought that as you have agreed the house settlement privately nobody else needs to get involved. Maintenance would only come into it where there are children but again this would only happen if it went through the courts. Anything you agree privately doesn't have to touch the courts. I don't see what her boyfriend can do about it. I wouldn't have thought he has any rights.

Re: Separation advise

I think you would be mad to move out especially as the house is in your name. If you have no children why would you need to pay her maintenance? I assume you are both working?
Get a signed witnessed agreement(with a solicitor) that you will sell the home and split the profit 50/50. I wouldn't leave under any circumstances, she may move her man in and refuse to leave. Put the house on the market, if she wants to leave she can, but I would stay put till its sold.
